US Court Orders Freedom of Kilmar Abrego Garcia from Immigration Custody

A federal judge has ruled the immediate discharge of Kilmar Abrego Garcia from immigration custody, concluding his continued confinement lacks legal authority.

"Since Abrego Garcia's return from erroneous detention in El Salvador, he has been taken back into custody, again without lawful authority," Judge Paula Xinis wrote in her ruling.

The case stems from a mistaken deportation to El Salvador in March, which US authorities later acknowledged was an error. Following his repatriation to the United States to face alien smuggling allegations, he was detained in federal detention.

In her decision, the court pointed out that the authorities does not have a current deportation order, which effectively blocks them from removing Mr. Abrego Garcia "at this juncture."

Context of the Case

The court proceedings center on disputed assertions. While the former administration contends that Abrego Garcia is a member of the MS-13 criminal organization, he vehemently denies this claim.

He has also entered a not guilty plea to the smuggling counts, which are part of a ongoing criminal case in the state of Tennessee.

The court, who was overseeing his petition to deportation in a Maryland district court, ruled that he must now comply with the conditions of his bond from custody in Tennessee. This decision shifts his supervision to the Tennessee court.
